Terms of Service

1. Agreement & Definitions

By accessing or using Trisende (trisende.co.uk, the “Platform”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

“SSOT Guardian” means the parent or legal guardian who creates and controls a child's profile. “Handshake” means the consent-based process linking a document or user to a child profile. “Paid Tokens” means tokens purchased with real money. “Promotional Tokens” means tokens awarded for platform activity. “APS” means the Adaptive Privacy Shield for live video. “S.A.F.E.” means the Secure Alert For Emergency system.

2. Eligibility & Account Types

You must be at least 18 years old to create an account. By registering, you represent you are legally capable of entering binding contracts under English law.

Trisende operates a multi-role system with a defined hierarchy:

  • Consumer roles (open registration): Parent/Guardian, Carer/Specialist, Organisation/Charity
  • Institutional roles (requires domain verification): School (.sch.uk), Local Authority (.gov.uk), Central Government (.gov.uk)
  • Internal roles (invite only): Staff, Admin

You should register with your highest-tier email address. Higher-tier accounts automatically receive access to lower-tier dashboards without additional registration. You are responsible for all activity under your account.

3. Child Data Sovereignty (SSOT)

Child profiles on Trisende are governed by the Single Source of Truth (SSOT) principle.

  • The SSOT Guardian has absolute authority over their child's profile — including creation, editing, deletion, and all sharing permissions
  • No school, local authority, or government body can modify a child's profile without the SSOT Guardian's consent
  • Schools may edit provision delivery data only (what support is being delivered) — not the child's needs, diagnosis, or outcomes
  • The Handshake system requires explicit SSOT Guardian acceptance before any data link is established
  • Handshakes can be revoked by the SSOT Guardian at any time, immediately severing the data link

By uploading a child's statutory document, you confirm you have legal authority to do so and that the information is accurate to the best of your knowledge.

4. AI Document Processing

Our patent-pending AI (7 UK patent applications, 43 claims) processes EHCP and statutory documents to generate ISPs, extract needs and provisions, and identify risks. Important limitations:

  • AI-generated outputs are advisory tools — they must be reviewed by a qualified human before use in statutory processes
  • Trisende does not guarantee the accuracy, completeness, or legal sufficiency of AI-generated content
  • ISP readiness scores are informational indicators, not legal assessments
  • The Consistency & Risk Engine flags potential issues but does not make determinations
  • You are responsible for verifying AI outputs against original source documents
  • AI does not replace professional legal, medical, or educational advice

You retain full ownership of all documents uploaded and generated. We do not use your documents to train AI models.

5. Token Economy & Payments

5.1 Token Types

Paid Tokens (Gold): Purchased via Stripe or PayPal. Conversion rate: 1 token = £0.01. Can be gifted on livestreams, used for care bookings, and withdrawn by carers (minimum £50). Paid tokens never expire.

Promotional Tokens (Silver): Awarded for platform activity (signup, profile completion, referrals, milestones). Can be used toward care bookings (maximum 50% of any booking). Cannot be withdrawn as cash. May have expiration dates.

5.2 Purchases & Refunds

Token purchases are non-refundable except where required by UK consumer law (14-day cooling-off period under Consumer Contracts Regulations 2013, forfeited when tokens are used). Tokens have no cash value outside the platform. We reserve the right to modify token pricing with 30 days' notice.

5.3 Platform Fees

  • Livestream gifts: 72% to creator, 28% platform fee
  • Care bookings: 85% to carer, 15% platform fee
  • Withdrawal: Minimum 5,000 tokens (£50). Processed via Stripe Connect or PayPal within 5 business days

5.4 Self-Gifting

Self-gifting on livestreams is disabled by default. Unusual gifting patterns are monitored for fraud prevention. Accounts engaging in fraudulent token activity will be suspended.

6. Care Services & Liability

6.1 Platform Role

Trisende facilitates connections between families and carers. We are not a care provider, employer, or agency. Carers on the platform are independent professionals responsible for their own conduct, insurance, and regulatory compliance.

6.2 Verification

We verify carers through our Triple-Gate system (ID document, live selfie match, DBS certificate). While we take reasonable steps to verify credentials, families should exercise their own judgement and conduct additional checks as appropriate for their child's needs.

6.3 Booking Liability

Trisende is not liable for: the quality of care provided; injury, loss, or damage arising from a care session; disagreements between families and carers; cancellations or no-shows by either party. Our dispute resolution process is available for booking-related issues.

6.4 Carer Obligations

Carers must: maintain valid DBS certification; hold appropriate insurance; comply with all safeguarding requirements; report concerns through the platform; not solicit off-platform bookings for families met through Trisende.

7. Livestreaming & APS

The Adaptive Privacy Shield (APS) automatically masks vulnerable individuals detected in live video streams. By initiating or joining a livestream:

  • You consent to AI-based detection and masking of subjects in the video
  • The fail-safe mode applies maximum masking when AI confidence is below threshold — this cannot be overridden
  • You must not deliberately circumvent privacy protections
  • Stream content must comply with community guidelines
  • Trisende may record streams for safeguarding purposes with prior notice

8. S.A.F.E. Emergency Alerts

The S.A.F.E. system delivers priority-overriding notifications for genuine emergencies. By using the platform:

  • You consent to receiving critical alerts that may override your device's silent/do-not-disturb mode
  • You must not trigger false emergency alerts — abuse will result in immediate account suspension
  • Trisende is not liable for delayed alert delivery caused by device settings, network conditions, or third-party notification services
  • S.A.F.E. does not replace 999 or other emergency services

9. Relief Network

The Relief Network connects families for mutual aid. It is not a regulated service. By using it:

  • All participants must be verified platform users
  • Location is shared at neighbourhood level only until both parties agree to connect
  • Trisende does not verify the accuracy of requests or the suitability of offers
  • Users meet at their own risk and should follow the safety guidelines provided
  • Report concerns using the in-app report function

10. Community Guidelines

The community (posts, comments, peer matching, messaging) is a safe space for SEND families. You must not:

  • Post abusive, discriminatory, threatening, or harmful content
  • Share others' personal information without consent
  • Impersonate another person or misrepresent your qualifications
  • Use the platform for commercial spam or solicitation
  • Post medical diagnoses or therapeutic advice without appropriate qualifications
  • Create multiple accounts to circumvent suspensions

We reserve the right to remove content and suspend accounts without notice for serious violations. Decisions can be appealed by emailing support@sencare.tech.

11. Organisation & Institutional Subscriptions

11.1 Organisation Listing Tiers

Free (£0/mo), Verified (£12/mo), Featured (£39/mo), Premium Partner (£149/mo). Annual billing available at 20% discount. All tiers are month-to-month unless on annual billing. Cancel any time; access continues until end of billing period.

11.2 School Subscriptions

Starter (£99/mo), Professional (£249/mo), Enterprise (£499/mo). 14-day free trial available. Annual contracts with quarterly payment options for Enterprise tier.

11.3 Local Authority Contracts

Tier 1 (£25,000/yr), Tier 2 (£45,000/yr), Tier 3 (£75,000/yr), Enterprise (£95,000+/yr). Annual contracts. Pilot programmes (3-6 months) available. Data Processing Agreements included.

11.4 Verification Badges

Verified and Premium badges are subject to our verification process. We reserve the right to revoke badges if information is found to be inaccurate or if the organisation fails to maintain compliance standards.

12. Intellectual Property

The Trisende platform — including its design, code, AI models, database schemas, and user interface — is protected by copyright and 7 UK patent applications (43 unique claims). You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the platform.

Content you create (documents, posts, reviews, child profiles) remains your intellectual property. You grant Trisende a non-exclusive, royalty-free licence to store, process, display, and transmit your content as necessary to provide the service. This licence terminates when you delete the content or close your account.

13. Indemnification

School & LA users: You agree to indemnify Trisende against claims arising from inaccurate data uploaded through bulk processing, incorrect EHCP information, or unauthorised sharing of child data.

Carers: You agree to indemnify Trisende against claims arising from your conduct during care sessions, including but not limited to injury, neglect, or breach of safeguarding obligations.

All users: You agree to indemnify Trisende against claims arising from your violation of these Terms or applicable law.

14. Limitation of Liability

To the maximum extent permitted by UK law:

  • Trisende is provided “as is” without warranties of any kind, express or implied
  • We do not warrant uninterrupted or error-free service
  • We are not liable for: decisions based on AI outputs; actions of carers or other users; care service quality; data loss beyond our reasonable control; indirect, consequential, special, or incidental damages
  • Our total aggregate liability to you is limited to the greater of: (a) amounts you paid us in the 12 months preceding the claim, or (b) £100

Nothing in these Terms excludes liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; any liability that cannot be excluded by UK law.

15. Dispute Resolution

Before initiating legal proceedings, you agree to:

  1. Contact us at support@sencare.tech with a detailed description of the dispute
  2. Allow 30 days for us to investigate and propose a resolution
  3. If unresolved, submit to mediation through a mutually agreed UK-based mediator
  4. If mediation fails after 60 days, either party may initiate court proceedings

This clause does not prevent you from making a complaint to the ICO or exercising statutory consumer rights.

16. Force Majeure

Trisende is not liable for failure to perform obligations caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemic, government action, war or terrorism, infrastructure failure (power, internet, cloud provider outage), or cyberattack. We will use reasonable efforts to resume service and communicate delays.

17. Acceptable Use of AI Assistant

The AI Assistant is provided for SEND-related queries. You must not use it to: generate content for illegal purposes; create false or misleading statutory documents; obtain medical diagnoses or prescribe treatments; generate content that could harm vulnerable individuals. We log all AI conversations for quality assurance and safeguarding purposes.

18. Termination

By you: Close your account at any time via Settings. You have 90 days to export data after closure.

By us: We may suspend immediately for: serious Terms violations, safeguarding concerns, fraudulent activity, or legal requirements. For other violations, we provide 14 days' notice to remedy. Suspension of paid subscriptions: pro-rata refund for remaining prepaid period unless terminated for cause.

On termination: tokens are forfeited (paid tokens refundable only if account terminated by us without cause); child profiles are deleted; documents are made available for export then deleted after 90 days.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes. If you are a consumer, you also retain any mandatory consumer protection rights afforded by the laws of your country of residence.

20. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trisende.
